2. Refund Policy

All payments made to PFM Host for services are non-refundable unless otherwise stated. This includes, but is not limited to, payments for hosting plans, domain registrations, add-on services, and any other products or services offered by PFM Host.

2.1. Refund Policy Extenstion

All services are eligible for a 7 day money back guarentee. This only applies to the first 7 days that the service is online, after such period expires refunds will not be granted.

3. Chargebacks and Fees

If you, as a User, initiate a chargeback or payment dispute against PFM Host without first notifying us and attempting to resolve the issue, you agree to pay a fee not exceeding $250. We encourage Users to reach out to our customer support for assistance with any billing-related concerns before resorting to chargebacks.

4. User Responsibilities

• Account Information: You are responsible for maintaining accurate and up-to-date account information, including contact details, billing information, and email addresses. PFM Host will not be held liable for any consequences resulting from outdated or incorrect account information.
• Lawful Use: You agree to use PFM Host's services for lawful purposes only. You shall not engage in any activity that violates local, national, or international laws and regulations. This includes, but is not limited to, copyright infringement, hacking, spreading malware, and any form of unethical or illegal activity.
• Resource Usage: You shall not engage in activities that consume excessive server resources or negatively impact other Users' experience. PFM Host reserves the right to suspend or terminate services if your resource usage adversely affects our infrastructure or other customers.
• Backups: While PFM Host may provide backup services, you are responsible for maintaining your own backups of data and content. PFM Host is not liable for any data loss or damages resulting from failure to back up your data.

5. Service Suspension and Termination

PFM Host reserves the right to suspend or terminate services at its discretion, without prior notice, for any violation of these Terms of Service or for activities that may harm the integrity, security, or performance of our services or infrastructure.

6. Modifications to Services and Terms

PFM Host may update or modify its services, features, and pricing from time to time. Additionally, we reserve the right to amend these Terms of Service. Users will be notified of any significant changes to the Terms of Service, and continued use of our services after such modifications constitute acceptance of the revised terms.

7. Disclaimer of Warranty

PFM Host provides its services on an "as-is" and "as-available" basis. We make no warranties, expressed or implied, regarding the reliability, availability, or suitability of our services for any particular purpose. Users agree to use our services at their own risk.

8. Limitation of Liability

PFM Host shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses arising from the use or inability to use our services.

You agree to indemnify and hold PFM Host, its officers, directors, employees, and affiliates harmless from any claims, liabilities, damages, expenses, and costs (including reasonable attorney fees) arising from your use of our services or violation of these Terms of Service.

These Terms of Service shall be governed by and construed in accordance with the laws in the State of Florida. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the competent courts located in Pinellas County, Florida.
